Estate Planning Form Purchase Instructions


Overview

All of the estate forms listed for sale are fill-in-the-blank forms.   You will need an Adobe Acrobat reader to view  the forms.  The forms are suitable for either a male or female.  A estate plan will include all of these forms if it is a living-trust centered plan. A will centered plan requires on  the Advanced Directive, the HIPPA Medical Release, and Financial Power of Attorney.

Statutory Will

This documents works for many situations; for example,  you can, among other things, name a guardian for your minor children.  You can also set up a custodial account to manage assets until a beneficiary reaches agent 25.   Separate gifts of the residence and cash gifts also also possible. The residuary gift covers every thing not given away in the previous paragraphs. The document must be witnessed by two adult not given gifts in the will.  Until so witnessed the will is not effective.  Do not notarize the will.   Gifts are made by signing the boxes next to your choices.

Statutory Advanced Directive

This is a refinement of the statutory form.  Your signature needs either an acknowledgment by a notary or two witnesses. Note that there is a right to die provision in the document.  Take some time to consider this important issue.

Financial Power of Attorney

This is a refinement of the statutory form.  Your signature needs an acknowledgment by a notary. Take some time to consider your choices of agent because a poor choice can lead to loss of your property.  Your signature needs an acknowledgment by a notary before the document is effective.

The HIPPA Medical Release Form for Others

The law, commonly known as HIPPA, is very restrictive concerning your medical records. 
This is to protect your privacy rights but, sometimes, this restriction is problematic when you are gravely ill. Your agent named in the Statutory Advanced Directive should also be named in this document.  He or she will need your medical information to make decisions on your behalf in case you are incapacitated.

Living Trust For Single Parent

Complete blanks as follows: top and section 1.1 enter your full name; section 1.4 and 1.5 is marriage information, if none enter "N/A"; section 7.2 is name for successor trustee and identifying information such as address or relationship.  This form containsbuilt-in pop-up instructions and form fields for help.  Additional pages can be attached to state more information For additional help use the Internet consultation form.  Remember the trust needs to be registered with your bank, stockbroker, and any real estate should be recorded in the county where it is situated. Forms for generally transferring personal property and trust real estate deed can also be purchased to complete the trust funding.  Once your trust is fully funded it avoids probate and transfers your estate directly to your children in equal amounts.  

You can make a pour over will (a will that transfers property into your living trust).  Use paragraph "5 c." of the Statutory Will and enter (e.g. successor trustee's name,  trustee, Your Name Living Trust dated mm-dd-2006").   A pour over will is a safety net in case something is not funded and left out of your trust.

Living Trusts for couples are more complicated.  Thus, we recommend a conference before starting and recommend custom work that cannot be canned into a one-size-fits-all trust.   This avoid conflicts of interests, or costly mistakes, due to a lack of understanding of the more complicated property rights, tax, and fiduciary duties between a husband and wife.

Trust Transfer Deed

On the Deed fill in your name as an individual signing, as the trustee, and use last name  to identify the trust and its date.  Use exhibit "A"  off your current deed.  If you cannot locate it go to an escrow officer and ask them to help you prepare and record the deed.  Your signature must be notarized before the Deed can be recorded, which is necessary in order to avoid the probate of your real estate.

Included also is a Preliminary Change of Ownership Form (PCOF) for the County of Los Angles (works throughout California).  Put in your name as seller and the the trust as buyer. Get Parcel Number from last tax bill. Fill out only Part II:  all questions are checked "no" except for "H1," which is "yes."  Sign page 2. Mail or take the Deed and the PCOF to county recorder's office.  Use goggle to find the recorder's office where the real estate is located.  A recording fee is required.  See instructions on recorders' websites for further  details.

Depending on form of ownership, Deeds can present complicated legal questions unsuitable to a do-it-yourself estate plan.  Your purchase does  not include deterring what your title description is,  or how your property is owned.  Consult with an escrow officer or with "customer service" at any title company.

Complete blanks as indicated.  The ususal forms need to complete a trust settlement are provided.  These forms require more sophistication to complete; therefore, you will require more assistance than with estate planning forms.
